Welcome to The Foam Theory. By scheduling, purchasing, or using our services, you (“Client”) agree to the following Terms & Conditions.
1. Services
The Foam Theory (“Company,” “we,” “our,” or “us”) provides exterior cleaning services including but not limited to:
- Pressure washing
- Soft washing
- Roof cleaning
- Driveway cleaning
- Paver sealing
- Exterior surface cleaning
- Window cleaning
- Related exterior maintenance services
Services are performed according to industry-standard methods and safety practices.
2. Estimates & Pricing
All estimates are based on the visible condition of the property at the time of inspection or quoting. Prices may change if:
- Additional square footage is discovered
- Surfaces are heavily neglected
- Specialty stains require additional treatment
- Access conditions differ from what was originally disclosed
- Additional labor or materials are required
Any pricing changes will be communicated prior to additional work being performed.
3. Payment Terms
Payment is due immediately upon completion of services unless otherwise agreed in writing. We accept approved payment methods listed on invoices or estimates. Late balances may incur additional fees. Returned checks or failed payments may be subject to additional charges.
4. Cancellations, Deposits & Weather Delays
Scheduling, deposits, refunds, weather-related rescheduling, and all related policies are described in detail in our Refund & Cancellation Policy, which is incorporated by reference into these Terms & Conditions.
5. Pre-Existing Conditions
Client acknowledges that exterior cleaning may reveal or worsen pre-existing conditions including but not limited to:
- Oxidation
- Paint deterioration
- Loose stucco
- Cracked mortar
- Deteriorated wood
- Loose tiles
- Failing caulking
- Window seal failure
- Roof leaks
- Previous repairs
- Faded surfaces
- Brittle materials
The Company is not responsible for damage resulting from pre-existing defects, improper installation, age-related deterioration, or previously damaged surfaces.
6. Stain Removal Disclaimer
While we use professional-grade equipment and cleaning solutions, not all stains can be completely removed. Some stains may be permanent due to:
- Age
- Oxidation
- Rust penetration
- Oil absorption
- Battery acid
- Tire marks
- Chemical reactions
- Previous treatments
- Surface damage
The Company does not guarantee complete stain removal.
7. Chemical Use
Soft washing and exterior cleaning services may involve the use of professional cleaning agents including sodium hypochlorite and surfactants. The Company follows recommended dilution and application practices. Client acknowledges that some surfaces may react differently to cleaning products depending on material condition, age, previous coatings, or environmental exposure. The Company is not responsible for unexpected chemical reactions caused by pre-existing surface conditions.
8. Landscaping Disclaimer
The Company takes reasonable precautions to protect landscaping through rinsing, dilution, and mitigation practices. However, some contact with cleaning solutions may be unavoidable. The Company is not responsible for damage to:
- Delicate plants
- Edible plants or herbs
- Drought-stressed landscaping
- Diseased vegetation
- Improperly maintained plants
- Potted plants left within service areas
Clients are encouraged to notify us of sensitive landscaping prior to service and remove vulnerable plants whenever possible.
9. Water Intrusion
Exterior cleaning involves water application. The Company is not responsible for water intrusion resulting from:
- Faulty window seals
- Cracked windows
- Damaged roofs
- Defective doors
- Failing caulking
- Improper construction
- Aging materials
- Pre-existing leaks
Client agrees to inform the Company of any known leak-prone areas before service begins.
10. Electronics & Personal Property
Clients are responsible for removing or protecting:
- Televisions
- Speakers
- Security cameras
- Patio electronics
- Decorations
- Furniture
- Fragile items
- Vehicles
The Company is not responsible for damage to items left within active work areas.
11. Roof Cleaning Disclaimer
Roof cleaning is typically performed using low-pressure soft wash methods. The Company does not guarantee against:
- Cracked tiles
- Loosened granules
- Exposure of pre-existing defects
- Water intrusion
- Leaks
- Cosmetic inconsistencies
Walking on roofs may not always be possible due to roof pitch, material condition, weather, or safety limitations.
12. Paver Sealing Disclaimer
Paver sealing results may vary depending on paver age, porosity, previous sealers, repairs, sun exposure, or moisture conditions. The Company does not guarantee:
- Exact gloss levels
- Exact color enhancement
- Stain-proof performance
- Slip-proof performance
- Uniform absorption
Clients must follow all post-care instructions provided after sealing services.
13. Photo & Video Release
Unless otherwise requested in writing, Client grants The Foam Theory permission to photograph or record the property before, during, and after service for documentation, training, marketing, website content, or social media content. No personal identifying information will be intentionally disclosed. Clients may opt out by notifying the Company in writing before service begins.
14. Limitation of Liability
To the maximum extent permitted by Florida law, the Company’s total liability for any claim arising from services provided shall not exceed the amount paid by the Client for the specific service performed. The Company shall not be liable for indirect damages, incidental damages, consequential damages, loss of use, loss of profits, HOA fines, or third-party claims.
15. Third-Party Services
Certain services may occasionally be performed in conjunction with subcontractors or service partners. The Company is not responsible for delays or damages caused by third-party providers outside our direct control.
16. Governing Law
These Terms & Conditions shall be governed by and interpreted according to the laws of the State of Florida.
